We are not required to conduct advertising for you or the System. We are not required to spend any particular amount in your Territory. It is at our discretion to determine how much to spend, and where to market, advertise and promote the System.

What This Means (2025 FDD)

According to the 2025 Cool Binz Franchise Disclosure Document, Cool Binz is not required to conduct advertising for franchisees or the Cool Binz system. However, Cool Binz has established a brand marketing fund where franchisees must contribute two percent (2%) of their gross sales monthly. Cool Binz will use these fees to develop, produce, and distribute advertising and public relations programs to promote the services offered by Cool Binz franchisees.

Cool Binz has the sole right to determine contributions and expenditures from the Brand Marketing Fund, and the sole authority to determine the selection of advertising materials and programs. Cool Binz will make a good faith effort to expend Brand Marketing Fees in the general best interests of the System on a national or regional basis. Cool Binz may use the Brand Marketing Fund to cover various advertising costs, including television, radio, magazine, and newspaper campaigns, public relations activities, advertising agencies, website development, and personnel costs.

While Cool Binz is not obligated to spend any amount on advertising in a franchisee's specific territory, the Brand Marketing Fund may be used for public relations or recognition of the Cool Binz brand, including creating and maintaining a website and soliciting potential franchisees. Additionally, Cool Binz may periodically assist franchisees in maintaining high-quality standards through customer surveys and interviews, with the cost of such programs borne by the Brand Marketing Fund, unless a franchisee's survey results fall below system-established minimum standards.
