What This Means (2025 FDD)
According to Cool Binz's 2025 Franchise Disclosure Document, franchisees receive certain protected rights within their assigned territory. Specifically, no other Cool Binz business may establish an office location within the franchisee's territory. Additionally, other Cool Binz businesses are prohibited from advertising in the franchisee's territory through print, media, door-to-door methods, mass electronic communication, or direct web-based advertising. However, the FDD notes that franchisees may experience some indirect advertising from other franchisees in media where the reach is difficult to restrict, such as radio or indirect web-based advertising.
Cool Binz will provide NORA (National or Regional Accounts) referrals and Call Center leads for the franchisee's assigned zip codes, contingent upon the franchisee's compliance with the Franchise Agreement and program requirements. If a franchisee fails to meet these requirements or adequately perform the program work, Cool Binz reserves the right to redirect these referrals and leads to another franchisee or to themselves.
It is important to note that these territorial protections do not extend to providing services to customers. Other Cool Binz franchisees or company-owned outlets can accept jobs and service customers within a franchisee's territory without restriction. The franchisee is not entitled to compensation for services provided by Cool Binz or other franchisees within their territory. Furthermore, Cool Binz retains the right to use alternative distribution channels, such as the Internet, to make sales within the franchisee's territory under different trademarks without compensating the franchisee.
