Is Cool Binz obligated to award me an additional Cool Binz Business or Territory upon my request?

Cool_Binz Franchise · 2025 FDD

Answer from 2025 FDD Document

Upon your request, we may, but are not obligated to, award you an additional COOL BINZ Business or an additional Territory, but any decision to do so will be in our sole discretion and judgment. At a minimum, to be considered for an additional Franchise you must be in compliance with your Franchise Agreement and have sufficient capital, and equipment to market and service both your Territory and the additional Territory.

If you are approved for an expansion territory, the Initial Package Fee may be waived for franchisees who qualify to expand; however, you need to pay the Initial Franchise Fee and sign a new Franchise Agreement, which may contain materially different economic terms than the initial Franchise Agreement you sign. You may not, without our prior written permission, solicit or

perform services for customers geographically located within the proposed Territory until you have purchased the Territory and signed a then current Franchise Agreement.

What This Means (2025 FDD)

According to Cool Binz's 2025 Franchise Disclosure Document, Cool Binz is not obligated to award you an additional Cool Binz Business or territory simply because you request it. The decision to grant you an additional franchise or territory is entirely at Cool Binz's discretion.

To be considered for an additional Cool Binz franchise, you must be in compliance with your existing Franchise Agreement. Additionally, you must demonstrate that you have sufficient capital and equipment to effectively market and service both your current territory and the additional territory. Meeting these minimum requirements does not guarantee approval, as the final decision rests solely with Cool Binz.

If Cool Binz approves you for an expansion territory, the Initial Package Fee may be waived if you qualify. However, you are still required to pay the Initial Franchise Fee and sign a new Franchise Agreement. It is important to note that this new Franchise Agreement may contain economic terms that are materially different from your initial agreement. You are not allowed to solicit or perform services for customers in the proposed expansion territory until you have finalized the purchase and signed the new Franchise Agreement with Cool Binz.
