Is a Cool Binz franchisee subject to competition from other franchisees or company-owned outlets?

Additionally, you may face competition from other franchisees, from outlets that we own, or from other channels of distribution or competitive brands that we control.
There are no Territory protections related to providing Services to customers located within your Territory.
Other COOL BINZ franchisees, or outlets we own, may accept jobs and Service customers in your Territory without restriction or limitation.
COOL BINZ franchisees and Company Stores may not advertise within your Territory without your and our written approval, except as provided in Sections 1.D and 2.F of Franchise Agreement. If you are not in full compliance with this Agreement, then we have the right to allow another compliant COOL BINZ franchisee or Company Store to advertise in your Territory.
We retain, as we deem appropriate, the rights to:

- establish, and allow other COOL BINZ franchisees to establish, COOL BINZ Businesses at any location outside of the Territory on any terms and conditions, but subject to the same marketing restrictions upon their servicing in the Territory that you are subject to when servicing in their Territory; under no circumstances will another COOL BINZ Business or Company Store advertise in print media, door-to-door, mass electronic communication, or direct web-based marketing in the Territory, without your prior written consent, except only as provided in Section 1.D and 2.F of this Agreement;

- establish, solicit, market to and build regional and national account relationships, whose offices may be located in the Territory as is further outlined in Sections 1.F and 1.H of this Agreement;

According to Cool Binz's 2025 Franchise Disclosure Document, a franchisee may face competition from other franchisees, company-owned outlets, or other channels of distribution or competitive brands that Cool Binz controls. While franchisees are granted a specific territory consisting of a set of zip codes, there are no territory protections related to providing services to customers within that territory. This means other Cool Binz franchisees or company-owned outlets can accept jobs and service customers within a franchisee's territory without restriction.
However, Cool Binz franchisees and Company Stores cannot advertise in print, media, door-to-door, mass electronic communications, or direct web-based advertising within a franchisee's territory without written approval. Cool Binz retains the right to allow another compliant franchisee or company store to perform work or advertise in a territory if the original franchisee is not in full compliance with the Franchise Agreement. Additionally, Cool Binz reserves the right to establish Cool Binz businesses at any location outside of a franchisee's territory and to solicit and build regional and national account relationships, even if their offices are located within a franchisee's territory.
In summary, while Cool Binz franchisees are granted a territory, they are not fully protected from competition within that territory from other franchisees or company-owned outlets. Prospective franchisees should consider the potential for competition when evaluating the Cool Binz franchise opportunity and discuss with the franchisor how they can differentiate themselves and succeed in a competitive environment.
