What This Means (2025 FDD)
According to Cool Binz's 2025 Franchise Disclosure Document, franchisees are responsible for securing and maintaining all necessary licenses, permits, and certificates required to operate their Cool Binz business. This includes complying with all applicable local, state, and federal laws, rules, and regulations. Franchisees must also ensure that their licenses remain in good standing with the relevant licensing authority throughout the entire term of the Franchise Agreement, including any renewal periods.
Cool Binz franchisees are obligated to investigate all federal, state, and local laws and regulations that pertain to their business operations. Furthermore, they must notify Cool Binz in writing within five days of any action, suit, or proceeding that could adversely affect the operation or financial condition of their Cool Binz business. This notification requirement ensures that Cool Binz is informed of any potential legal or regulatory challenges faced by its franchisees.
In essence, Cool Binz places the onus on the franchisee to proactively manage their compliance with all applicable laws and regulations. This is a common practice in franchising, as the franchisee is typically responsible for the day-to-day operations of their business and is therefore best positioned to ensure compliance with local requirements. The requirement to maintain licenses in good standing for the entire term and renewals underscores the importance of ongoing compliance and the potential consequences of failing to do so.
