Is a Cool Binz franchisee required to purchase or lease the initial truck from Cool Binz?

Currently, you are required to purchase or lease the initial truck from us. We reserve the right to require that you purchase all additional trucks through our approved supplier(s). COOL BINZ Businesses will use trucks for the COOL BINZ Business that meet our design and operating specifications for model type, color, trademark representation, and appearance. These specifications are included in our Manuals. All trucks purchased or leased for the COOL BINZ Business are to be, and maintained, in a "good" condition as defined by KELLEY BLUE BOOK ("good" condition means that the truck is free of any major defects). The paint, body and interior must have only minor (if any) blemishes, and there may not be any major mechanical problems. In states where rust is a problem, this should be very minimal. All trucks used in connection with the COOL BINZ Business are to be decaled as required by us and the decals are to be free of defects. We may require that you purchase/lease a new truck or remodel/refurbish your existing trucks to meet our then-current System Standards at any time during the Term, at your expense.
In addition, you may be required to install, use and maintain a GPS for your truck(s) and the bins, including payment of the then-current monthly fees to a designated GPS vendor in the future.

What This Means (2025 FDD)
According to Cool Binz's 2025 Franchise Disclosure Document, franchisees are required to purchase or lease their initial truck directly from Cool Binz. Cool Binz also retains the right to mandate that franchisees acquire all subsequent trucks through their designated or approved suppliers.
The FDD specifies that Cool Binz businesses must operate trucks that adhere to the franchisor's design and operational standards, encompassing model type, color, trademark representation, and overall appearance. These specifications are detailed in the Cool Binz manuals. All trucks, whether purchased or leased, must be maintained in good condition, aligning with the Kelley Blue Book's definition of "good" condition, meaning they are free of major defects with only minor blemishes to the paint, body, and interior, and minimal rust.
Cool Binz also has the right to require franchisees to purchase or lease a new truck or to remodel or refurbish existing trucks to meet the system's current standards at any point during the franchise term, with the franchisee bearing the associated expenses. Additionally, Cool Binz may require the installation and maintenance of a GPS system in the trucks and bins, including the payment of monthly fees to a designated GPS vendor.
