Must other forms of advertising be approved by Cool Binz in writing?

We have the right to formulate and design the content of the materials, and to discontinue the materials if, in our sole business judgment, we determine a more effective alternative method of advertising. Any other forms of advertising must be approved by us in writing.
Under the mandatory KickStart marketing program, which is included in your Initial Promotional Package, you will receive approximately $5,000 in digital marketing to promote the opening of your business.
You must also spend a minimum of 10% of Gross Sales annually on local advertising until your fleet of Portable Equipment containers are at least 80% rented and then, at that point, you are required to spend at least 5% of Gross Sales annual on local advertising. You must use our approved advertising and marketing materials, or receive our written approval of any and all other advertising and marketing materials before their first use. We reserve the right to designate one or more approved supplier(s) for all advertising and marketing materials. In order to obtain approval of advertising and marketing materials, you must submit such proposed advertising material to us for review at least ten business days before the proposed first use. If we take no action within such ten business day period, the materials shall be deemed disapproved and you may not use such materials. The approval or disapproval is in our sole discretion. We also may, in our sole discretion, require you to immediately discontinue use of any advertising or marketing materials at any time, even if previously approved or provided by us.
Except as we authorize in writing in advance, you may not: (i) link or frame our website; (ii) conduct any business or offer to sell or advertise any products or services on the worldwide web; or (iii) create or register any Internet domain names in connection with your COOL BINZ Business.
Prior to establishing such social media page(s), you are required to obtain our prior written approval of the content to be posted on such social media page(s).

What This Means (2025 FDD)
According to Cool Binz's 2025 Franchise Disclosure Document, any advertising materials that a franchisee intends to use must receive written approval from Cool Binz. Specifically, franchisees must submit proposed advertising materials to Cool Binz for review at least ten business days before their intended use. If Cool Binz does not respond within this ten-day period, the materials are considered disapproved. Cool Binz retains the right to demand the immediate cessation of any advertising or marketing materials at any time, even if previously approved. All advertising and marketing content must adhere to Cool Binz's current standards and specifications.
Cool Binz provides an initial promotional package that includes approximately $5,000 in digital marketing to promote the opening of the business. Franchisees are obligated to spend a minimum percentage of gross sales annually on local advertising. This requirement is 10% of gross sales until the fleet of portable equipment containers reaches 80% rented, after which the requirement decreases to 5%. Franchisees must use Cool Binz's approved advertising and marketing materials or obtain written approval for any other materials before use. Cool Binz reserves the right to designate approved suppliers for all advertising and marketing materials.
Cool Binz also maintains control over online advertising. Cool Binz retains the sole right to advertise the system on the Internet and to create, operate, maintain, modify, or discontinue the use of websites using the Cool Binz marks. Franchisees may access the Cool Binz website, but they are restricted from linking or framing the website, conducting business or advertising products or services on the web (unless authorized in writing), or creating or registering any Internet domain names connected to their Cool Binz business. The only exception is listing the Cool Binz business in an online directory. Franchisees must also obtain written approval before establishing a social media presence for their Cool Binz business.
