While franchisees have the right to advertise, market, and provide services to customers within their territory, there are no territory protections related to providing services to customers located within the assigned territory. Other Cool Binz franchisees or company-owned outlets may accept jobs and service customers within a franchisee's territory without restriction. However, other Cool Binz franchisees and Company Stores may not advertise within your Territory without your and Cool Binz's written approval.
Cool Binz franchisees may not perform services or advertise via print, media, door-to-door, mass electronic communications, or direct web-based advertising outside of the Territory without Cool Binz's approval. Engaging in such "Out-of-Territory Conduct" is a default of the Franchise Agreement and may result in a fee of $10,000 and/or termination of the Franchise Agreement. All zip codes that have not been awarded to a Cool Binz franchisee or Company Store are corporately owned ("COOL BINZ Corporate Territory") and franchisees may not advertise there without prior written permission.
