Who is responsible for the cost of maintaining and repairing the Clear Pest Pros Computer System?

At our request, you shall purchase or lease, and thereafter maintain, the Computer System, Clear Pest Pros Software, and the Required Software. You agree to pay all fees associated with the use of Clear Pest Pros Software and any other Required Software, which may be payable to us or our approved or designated suppliers. You expressly agree to strictly comply with our thencurrent standards and specifications for all items associated with your Computer System, Clear Pest Pros Software and any Required Software, including any security software. You agree, at your own expense, to keep your Computer System in good maintenance and repair and install such upgrades, additions, changes, modifications, substitutions, and/or replacements to your Computer System or Required Software as we direct from time to time in writing. You agree that your compliance with this Section shall be at your sole cost and expense.

What This Means (2025 FDD)

According to Clear Pest Pros' 2025 Franchise Disclosure Document, the franchisee is responsible for the costs of maintaining and repairing the Computer System. The franchisee must purchase or lease the Computer System, Clear Pest Pros Software, and the Required Software at Clear Pest Pros' request. The franchisee is also responsible for keeping the Computer System in good maintenance and repair, including installing any upgrades, additions, changes, modifications, substitutions, and/or replacements as directed by Clear Pest Pros in writing.

This means that as a Clear Pest Pros franchisee, you will bear the financial burden of keeping your computer systems operational and up-to-date. This includes not only the initial purchase or lease costs but also ongoing maintenance, repairs, and any required upgrades. Clear Pest Pros maintains the right to specify the brands, types, makes, and models of computer systems and hardware that franchisees must use.

Clear Pest Pros also has the right to connect with the franchisee's Computer System to monitor or retrieve data. The franchisee must provide all access codes and IP addresses to facilitate this access within 30 days of opening the Clear Pest Pros Business. All client and customer data is the property of Clear Pest Pros, and any data not previously obtained by them must be transmitted to them immediately upon termination or expiration of the agreement. Franchisees must use Clear Pest Pros Software or other Required Software for maintaining customer records. Franchisees must also establish and maintain, at their expense, an accounting system that conforms to Clear Pest Pros' requirements and formats.
