Is Clear Pest Pros required to make the POS System part of their operating system?

requirement at our discretion. We shall have the right to specify or require that certain brands, types, makes, and/or models of communications, computer systems, and hardware be used by you, including without limitation: (i) a compatible "back office" computer system that complies with our standards and specifications; (ii) a custom and proprietary point of sale system (iii) printers and other peripheral hardware or devices; (iv) archival back-up systems; (v) Internet access mode and speed; and (vi) physical, electronic, and other security systems (collectively, the "Computer System"). Currently, your Computer System must include a DSL or cable modem high-speed Internet connection that meets the requirements of the System Standards and for handling of our then-current Clear Pest Pros CRM or other Required Software. Computer specifications for hardware and Internet connectivity are provided in Sections 2.H and 2.I of the Franchise Agreement. We estimate that these systems will cost between $3,770 and $5,200 to purchase.

We shall have the right, but not the obligation, to develop or designate: (i) computer software programs you must use in connection with any component of the Computer System, including Clear Pest Pros CRM or other software, designated business management software and designated accounting software (the "Required Software"), which you shall install at your own expense; (ii) updates, supplements, modifications, or enhancements to the Required Software, which you shall install at your own expense; (iii) the tangible media upon which you record data; and (iv) the database file structure of the Computer System. You will be responsible for the payment of all fees associated with the Required Software (including the Clear Pest Pros CRM), Computer System and POS System.

You agree, at your own expense, to keep your Computer System in good maintenance and repair and install such upgrades, additions, changes, modifications, substitutions, and/or replacements to your Computer System or Required Software as we direct from time to time in writing. You agree that your compliance with these requirements shall be at your sole cost and expense. We estimate that the annual cost of any optional or required maintenance, updating, upgrading, or support contracts for the Computer System will be $150 to $500 per year.

We may require that your Computer System be programmed to automatically transmit data and reports about the operation of Clear Pest Pros Business to us. We shall also have the right to, at any time without notice, electronically connect with your Computer System to monitor or retrieve data stored on the Computer System or for any other purpose we deem necessary. There are no contractual limitations on our right to access the information and data on your POS System, Clear Pest Pros CRM, and Computer System.

What This Means (2025 FDD)

According to Clear Pest Pros's 2025 Franchise Disclosure Document, Clear Pest Pros has the right to specify certain computer systems, including a point of sale system (POS). However, Clear Pest Pros is only required to make the POS System part of their operating system if they choose to do so in the future. Currently, franchisees must have a DSL or cable modem high-speed internet connection at their office site that meets the system standards for handling the Clear Pest Pros software.

Clear Pest Pros also has the right, but not the obligation, to develop or designate computer software programs and web-based applications that franchisees must use, including Clear Pest Pros Software, business management software, and accounting software. Franchisees are responsible for the payment of all fees associated with the required software, computer system, Clear Pest Pros Software, and POS System.

Clear Pest Pros may require franchisees' computer systems to automatically transmit data and reports about the business's operation. Clear Pest Pros also has the right to electronically connect with the franchisee's computer system to monitor or retrieve data. Franchisees must provide all access codes and other information to facilitate this access within 30 days of opening the Clear Pest Pros Business. All client and customer data is the property of Clear Pest Pros and must be transmitted to them upon termination or expiration of the agreement.
