What This Means (2025 FDD)

According to the 2025 Clear Pest Pros Franchise Disclosure Document, in the mutual release agreement, the franchisor releases the franchisee and their associated parties from claims. Specifically, Clear Pest Pros, for themselves and for their employees, agents, heirs, successors, and assigns, and for every other person, firm, entity, and/or corporation succeeding to the interest of the franchisor, releases, acquits, and forever discharges the Franchise Owner(s) and/or Franchisee and their directors, officers, shareholders, employees, agents, legal representatives.

This mutual release covers any and all claims, actions, causes of action, demands, costs, losses, expenses, and suits whatsoever and of every conceivable kind, character, and nature, whether absolute or contingent, and whether known or unknown, which either party may have against the other, by reason of, or arising out of, or in any way related to any acts or omissions of the other party occurring prior to the date of this Release.

This means that upon signing the release, Clear Pest Pros gives up its right to sue the franchisee for any issues that occurred before the release date, provided the franchisee also releases Clear Pest Pros from any potential claims. This type of mutual release is common when renewing or transferring a franchise, or when settling disputes, ensuring a clean slate going forward for both parties. Franchisees should carefully review any such release with their legal counsel to understand the full scope of what they are giving up.
