Regarding site selection and acquisition/lease for a Clear Pest Pros franchise, which sections of the Franchise Agreement are relevant?

st Pros Business, we will:

- Designate the Territory for a Clear Pest Pros Business (Section 6 of the Summary Page of the Franchise Agreement). We do not provide any assistance with (a) selecting a business site or negotiation of any lease or purchase of any site, (b) conforming the site to local ordinances and codes and obtaining any required permits, or (c) hiring and training employees (other than the required training discussed in Section 3.A of the Franchise Agreement). Your business site, whether you operate from your commercial location, must be located within the Territory, and will be approved by us. To approve your site, we will consider several factors, such as its size, condition, orientation within the Territory, its co-tenants, traffic patterns, and other details about the location (Section 1.D of the Franchise Agreement). There is no time limit for us to approve sites, but it will not be unreasonably delayed. Failure to select a site and open within the prescribed time period is a default of the franchise agreement, any may result in a termination of your franchise agreement.

- Provide to you an Initial Package that includes logo-wear, tablet, backpack sprayer, radar, printed material, and consumables. The items in the Initial Package are provided by us and by designated suppliers named by us. (Section 2.B of the Franchise Agreement).

- Provide you with four (4) months of targeted marketing in your Territory. (Section 2.B of the Franchise Agreement).

- Loan to you a copy of our copyrighted Operations Manual and System Standards, and other proprietary materials or manuals as we may publish and distribute to you periodically (Section 3.C of the Franchise Agreement). The Operations Manual is approximately 303 pages. The Operations Manual will include recommended price ranges for the services, but you will set your own prices.

- Give prior approval for use of business forms, business stationery, business cards, advertising materials, permanent materials, and forms that you intend to use (Section 7.A of the Franchise Agreement). We will continue to do this after you open the Clear Pest Pros Business.

- Give prior approval to all marketing, advertising, and promotional materials prepared by you within ten days of our receipt of the proposed materials for Franchises (Section 2.G of the Franchise Agreement).

According to Clear Pest Pros's 2025 Franchise Disclosure Document, several sections of the Franchise Agreement pertain to site selection and acquisition/lease. Section 6 of the Summary Page of the Franchise Agreement designates the territory for the Clear Pest Pros Business. Section 1.D of the Franchise Agreement discusses factors the franchisor considers for site approval, such as size, condition, orientation within the territory, co-tenants, and traffic patterns.
The FDD specifies that Clear Pest Pros does not provide assistance with selecting a business site, negotiating a lease or purchase, conforming the site to local ordinances and codes, or obtaining required permits. The franchisee must select a business office site within the designated territory, and Clear Pest Pros must approve the site at their sole discretion. The franchisee cannot locate their office outside the territory without express written consent from Clear Pest Pros; doing so may result in a Non-Compliance Fee or termination of the agreement.
Notably, a Clear Pest Pros franchisee may operate from a home office for the first 12-18 months, after which they must establish a commercial or industrial Office Site within their territory. If a franchisee's office site is located outside of their territory with prior permission and a new Clear Pest Pros franchisee purchases the territory where the office site is located, the franchisee will need to move the location of their office site to another site approved in writing by Clear Pest Pros, unless they have obtained written authorization from Clear Pest Pros, as well as from the new Clear Pest Pros franchisee. Failure to select a site and open within the prescribed time period is a default of the franchise agreement, and may result in a termination of the franchise agreement.
