Does Clear Pest Pros grant exclusive territories to franchisees?

According to Clear Pest Pros's 2025 Franchise Disclosure Document, franchisees do not receive an exclusive territory. The Territory is defined by specific zip codes, typically including between 350,000 to 450,000 people, with a maximum of 500,000. Clear Pest Pros determines these demographics using data from a national demographics company, GbBIS.

As Clear Pest Pros franchisees do not receive exclusive territories, they may face competition from other franchisees, company-owned outlets, other distribution channels, or competitive brands controlled by Clear Pest Pros. While franchisees have the right to advertise and service customers within their designated territory, they need approval to advertise outside of it, with restrictions on print, media, and targeted web-based advertising. Violating these advertising restrictions can result in a fine of the greater of $500 or 50% of the job invoice amount, and/or termination of the Franchise Agreement.

Clear Pest Pros Businesses and Company Stores are restricted from advertising within a franchisee's territory without written approval from both the franchisee and Clear Pest Pros. Franchisees also need prior written permission to advertise or service customers outside their territory, even in areas not yet assigned to another Clear Pest Pros Business or Company Store, as these unassigned zip codes are considered corporately owned by Clear Pest Pros. Clear Pest Pros retains the right to sell products through alternative channels like the Internet or catalog sales, even within a franchisee's territory, as long as it is not through another Clear Pest Pros Business.

Clear Pest Pros also maintains the exclusive right to manage projects undertaken jointly by multiple Clear Pest Pros Businesses and can limit or prohibit franchisees from directly negotiating with each other on these jobs. The company reserves the right to establish Clear Pest Pros Businesses both inside and outside a franchisee’s territory, subject to certain restrictions on servicing within that territory. Additionally, Clear Pest Pros can establish relationships with national or regional accounts (NORAs), even if their offices are located within a franchisee's territory, and franchisees are expected to service NORA customer referrals within their territory according to Clear Pest Pros's standards.
