What This Means (2025 FDD)
According to the 2025 Clear Pest Pros Franchise Disclosure Document, franchisees are restricted in how they use the Clear Pest Pros marks. Specifically, a franchisee cannot use the Clear Pest Pros mark as part of their corporate or legal business name, nor can they use it with modifying words, terms, designs, or symbols, unless Clear Pest Pros explicitly licenses those uses to the franchisee. This restriction also applies to the name Safer Home Services. Franchisees are also prohibited from using the Clear Pest Pros mark to sell unauthorized services or products, or in any way that Clear Pest Pros has not expressly authorized in writing.
This policy is fairly standard in franchising, as franchisors need to protect their brand identity and ensure consistent representation across all franchise locations. By limiting how franchisees can use the Clear Pest Pros mark, the franchisor maintains control over its brand and prevents franchisees from creating potentially confusing or damaging variations. This helps to ensure that customers recognize and trust the Clear Pest Pros brand, regardless of the specific location they visit.
It is important for prospective Clear Pest Pros franchisees to understand these trademark usage restrictions. While the Franchise Agreement grants a license to operate under the Clear Pest Pros name, this license is not unlimited. Franchisees must adhere to the specific guidelines provided by Clear Pest Pros regarding trademark usage. Failure to comply with these guidelines could result in a breach of the Franchise Agreement and potential legal consequences. Therefore, franchisees should carefully review the Franchise Agreement and seek clarification from Clear Pest Pros on any questions they have regarding trademark usage.
