Is a Clear Pest Pros franchisee required to use the franchise management software system?

Throughout the term of this Agreement, you must:

- utilize our then-current franchise management software system in the operation of the Clear Pest Pros Business, which may be developed by us or designated by us (the "Clear Pest Pros Software"), unless we approve an alternate software supplier;

- sign and maintain a quarterly renewable Clear Pest Pros Software licensing agreement (attached as Exhibit B to this Agreement);

- pay the then-current monthly software fee and, if required, set up fee, for the Clear Pest Pros Software (the "Software Fee") in the same manner and at the same time as you pay the monthly Royalty;

- pay the then-current monthly technology fee for website hosting, email hosting, business phone, and other required technology or marketing related expenses (the "Technology Fee") in the same manner and at the same time as you pay the monthly Royalty; and
-
- utilize, sign a license agreement for, and pay for, any future proprietary software program we may designate for use with the System.

What This Means (2025 FDD)
According to Clear Pest Pros's 2025 Franchise Disclosure Document, franchisees must use the franchisor's designated franchise management software system to operate their business. The franchisee is obligated to utilize the then-current Clear Pest Pros Software, which may be developed or designated by the franchisor, unless an alternate software supplier is approved.
To formalize the software usage, franchisees must sign and maintain a quarterly renewable Clear Pest Pros Software licensing agreement. Along with this agreement, franchisees are required to pay a monthly software fee and a set-up fee, if applicable, for the Clear Pest Pros Software. These fees are paid in the same manner and at the same time as the monthly royalty payments.
In addition to the software fee, franchisees must also pay a monthly technology fee for website hosting, email hosting, business phone, and other required technology or marketing-related expenses. Furthermore, franchisees are obligated to use, sign a license agreement for, and pay for any future proprietary software program that Clear Pest Pros may designate for use with the system. This ensures that all franchisees operate on a unified technology platform, adhering to the standards set by the franchisor.
