What This Means (2025 FDD)
According to the 2025 Clear Pest Pros Franchise Disclosure Document, there are specific actions that can be interpreted as abandonment of the business, leading to termination of the franchise agreement. If a franchisee ceases to continuously and actively operate the Clear Pest Pros business for five consecutive days, this can be considered abandonment. However, there is an exception if the cessation is due to an act of God or other circumstances beyond the franchisee's control, as determined by Clear Pest Pros.
Another action that can be viewed as abandonment is if the business telephone is disconnected at any time and a new number is not immediately reinstalled or reconnected. Additionally, any other conduct that Clear Pest Pros determines to constitute abandonment of the business can also lead to termination.
These terms are fairly standard in franchise agreements, designed to ensure that franchisees are actively engaged in operating the business and maintaining its presence in the market. Prospective Clear Pest Pros franchisees should understand these conditions and ensure they have plans in place to address potential disruptions to their business operations to avoid any risk of being deemed to have abandoned the franchise.
