What does Clear Pest Pros consider the Clear Pest Pros software to be?

According to the 2025 FDD, Clear Pest Pros considers its Clear Pest Pros Software to be a proprietary product and confidential information. The franchisee must use the Clear Pest Pros Software, or other Required Software, for maintaining customer records. Clear Pest Pros has confidential access to franchisee databases and related information from the Clear Pest Pros Software, which it uses to compute the Royalty due on Gross Sales, and to make other evaluations and verifications.

Clear Pest Pros retains title to the Clear Pest Pros Software, and the franchisee is granted a renewable license to use the software. The license is quarterly and automatically renews each quarter, remaining in effect throughout the term of the Franchise Agreement. The franchisee is prohibited from copying, reverse-engineering, or making the software available to any other party. The franchisee must take appropriate action with its employees and any other parties to ensure non-disclosure of the software.

Clear Pest Pros can specify or require certain brands, types, makes, and/or models of computer systems and hardware, including the Clear Pest Pros Software. Franchisees are responsible for paying all fees associated with the Required Software, Computer System, Clear Pest Pros Software, and POS System. Clear Pest Pros reserves the right to create additional proprietary software programs, which franchisees must use in connection with the Clear Pest Pros Business and are to be included as part of the Required Software.
