- you must have attended Initial Training and your business must be open in order to transfer the Clear Pest Pros Business;

- You must affirm and comply with your post-termination obligations, including, without limitation, such obligations set forth in Sections 6 or 13.

- the transferee must obtain, within the time limits set by us, and maintain thereafter, all permits and licenses required for the operation of the Clear Pest Pros Business;

- to the extent required by the terms of any leases or other agreements, the lessors or other parties must have consented to the proposed transfer;

- the transfer must be made in compliance with any laws that apply to the transfer, including state and federal laws governing the offer and sale of franchises; and

- if required by us, in our sole discretion, transferee must purchase all or a portion of the Initial Package, new or refurbished equipment, inventory, new vehicles/vehicle wraps, and complete remodeling, refurbishing, renovation or upgrades required by Franchisor, etc. to ensure the Clear Pest Pros Business is in compliance with our current System Standards and in well-maintained condition.
We shall have 60 days from the date of the written notice to approve or disapprove in writing of your proposed assignment.

What This Means (2025 FDD)
Based on the 2025 Clear Pest Pros Franchise Disclosure Document, if a franchisee seeks to transfer their franchise, including the lease, certain conditions must be met for Clear Pest Pros to approve the transfer. The lessor must consent to the proposed transfer, if required by the lease terms. The potential transferee must secure and maintain all necessary permits and licenses for operating the Clear Pest Pros business, within the time limits set by the franchisor.
Additionally, Clear Pest Pros has the right to ensure the business aligns with their current system standards. This may require the transferee to purchase all or a portion of the Initial Package, new or refurbished equipment, inventory, new vehicles/vehicle wraps, and complete remodeling, refurbishing, renovation or upgrades. The FDD states that Clear Pest Pros will evaluate the proposed transferee based on the same criteria used for new franchisees and provide them with any disclosures required by law.
Clear Pest Pros has 60 days from the written notice to approve or disapprove the proposed assignment. If Clear Pest Pros fails to provide notice of approval or disapproval within this 60-day period, the transfer request is deemed rejected. These stipulations ensure that any transfer maintains the standards and legal compliance of the Clear Pest Pros franchise system.
