What This Means (2025 FDD)

According to Clear Pest Pros's 2025 Franchise Disclosure Document, if a franchisee purchases a franchise in Washington and a dispute arises requiring arbitration or mediation, the location of the proceedings will be in Washington state. However, the exact site can be determined in one of three ways: it can be a location mutually agreed upon by both parties (Clear Pest Pros and the franchisee) at the time of the arbitration or mediation, or it can be determined by the arbitrator or mediator during the proceedings.

This means that franchisees in Washington have some protection under Washington state law regarding dispute resolution. They are not necessarily required to travel to another state to resolve disputes with Clear Pest Pros. This can save on travel costs and legal fees, as local counsel can be used more easily.

However, it is important to note that the final location can be determined by the arbitrator or mediator, which introduces some uncertainty. Franchisees should consider this when evaluating the franchise agreement and understand that while they have the right to arbitrate or mediate in Washington, the specific location might not be their choice. Prospective franchisees should seek legal counsel to fully understand their rights and obligations under the franchise agreement and Washington state law.
