What This Means (2025 FDD)
According to Clear Pest Pros's 2025 Franchise Disclosure Document, franchisees face specific restrictions on advertising and servicing customers outside of their designated territory. A Clear Pest Pros franchisee may not advertise via print, media, or targeted web-based advertising outside their territory without prior approval from Clear Pest Pros. This restriction extends to the distribution of materials at trade shows, home shows, and similar locations, unless the materials only reference the Clear Pest Pros toll-free phone number or the home office address. Even listings in membership rosters of organizations are considered advertising and are therefore subject to these restrictions.
Advertising or servicing outside of the franchisee's territory without approval constitutes a default under the Franchise Agreement. This default can result in a fine for the Clear Pest Pros franchisee, calculated as the greater of $500 or 50% of the job invoice amount for the unauthorized job. Furthermore, such a violation may lead to the termination of the Franchise Agreement, highlighting the importance of adhering to these territorial advertising restrictions.
Clear Pest Pros also maintains corporate ownership of all zip codes not awarded to a franchisee or Company Store, which are designated as "Clear Pest Pros Corporate Territory." Franchisees are prohibited from advertising or providing services in these areas without prior written permission from Clear Pest Pros. This policy ensures that Clear Pest Pros retains control over unassigned territories and can manage its brand presence and service delivery in those areas. These restrictions are in place to protect the integrity of the franchise system and prevent conflicts between franchisees and the franchisor.
