What This Means (2025 FDD)
According to the 2025 Clean Your Dirty Face Franchise Disclosure Document, the rights of both the franchisor and franchisee are cumulative. This means that if either party exercises one right or remedy outlined in the agreement, it does not prevent them from also utilizing any other rights or remedies they possess, whether specified in the agreement or legally available.
This provision ensures that Clean Your Dirty Face and its franchisees retain maximum flexibility in addressing any breaches or disputes that may arise. For example, if Clean Your Dirty Face waives a franchisee's failure to strictly comply with one term of the agreement, that waiver doesn't prevent Clean Your Dirty Face from enforcing that term at a later time, or from enforcing any other term of the agreement.
For a prospective Clean Your Dirty Face franchisee, this clause underscores the importance of understanding all aspects of the franchise agreement. Franchisees should be aware that Clean Your Dirty Face retains the ability to enforce any and all rights, even if they have previously been lenient. This also benefits the franchisee, as they can pursue multiple avenues of recourse if Clean Your Dirty Face violates the agreement.
