What This Means (2025 FDD)
According to the 2025 Clean Your Dirty Face FDD, the franchisor, Mud Franchising, LLC, retains ownership of customer information generated by Clean Your Dirty Face Facial Bars. This includes data such as customer names, addresses, telephone numbers, email addresses, credit information, buying habits, preferences, demographic information, and any other information stored in the CYDF Facial Bar's computer system.
This means that while franchisees collect and utilize this customer data in their daily operations, Clean Your Dirty Face maintains ultimate control and ownership. Franchisees are granted the right to use this information only to the extent necessary to perform their duties and must protect its confidentiality. They are considered agents of the franchisor in this regard.
For a prospective Clean Your Dirty Face franchisee, this has several implications. First, they must adhere to the franchisor's policies regarding data usage and security. Second, they cannot use the customer data for any purpose not authorized by the franchise agreement, such as promoting a competing business. Finally, upon termination or transfer of the franchise, the franchisee must relinquish all customer data to Clean Your Dirty Face. This is a fairly standard practice in franchising, as it allows the franchisor to maintain brand consistency and protect its customer relationships across the entire system.
