- (2) We and our affiliates use and promote, and license others to use and promote, certain trademarks, service marks, and other commercial symbols, and may create, use, and license other trademarks, service marks, and commercial symbols, each of which have gained and will continue to gain public acceptance and goodwill, for use in operating or identifying CYDF Facial Bars (collectively, the "Marks").
- (3) We and our affiliates have also developed a distinctive business format and business system, using the methods, procedures, signs, designs, layouts, standards, specifications that we approve, and offering those products and services that we approve, all of which we may improve, further develop, or modify from time to time, (i) for CYDF Facial Bars, using the Marks (the "Franchise System").
- (4) We grant franchises to persons who meet our qualifications and are willing to undertake the investment and effort to use the Marks and the Franchise System to own and operate a CYDF Facial Bar.

According to Clean Your Dirty Face's 2025 Franchise Disclosure Document, the 'Marks' refer to certain trademarks, service marks, and other commercial symbols that Clean Your Dirty Face and its affiliates use, promote, and license to others. These marks have gained and will continue to gain public acceptance and goodwill for use in operating or identifying CYDF Facial Bars.
Clean Your Dirty Face grants franchises to individuals who meet their qualifications and are prepared to invest the necessary resources and effort to utilize the Marks and the Franchise System in owning and operating a CYDF Facial Bar. The franchisee's right to use the Marks and the Franchise System is derived solely from the Franchise Agreement, and they may only be used to operate the business according to the agreement and Clean Your Dirty Face's System Standards. Franchisees cannot sublicense or assign their right to use any Marks or the Franchise System.
As a Clean Your Dirty Face franchisee, you must display the Marks prominently as prescribed by Clean Your Dirty Face at your business, as well as on forms, advertising, supplies, employee uniforms, and other designated materials. Franchisees are prohibited from using any other trademarks, service marks, or commercial symbols to identify or operate their business. They must also identify themselves as the independent owner of their business in the manner prescribed by Clean Your Dirty Face.
Clean Your Dirty Face retains the right to modify or discontinue the use of any Mark at any time and may require franchisees to use additional or substitute Marks. Franchisees are obligated to replace the Marks at their business with the modified, additional, or substitute Marks specified by Clean Your Dirty Face and comply with all related directions within a reasonable time after receiving notice. However, Clean Your Dirty Face is not required to reimburse franchisees for any costs or expenses associated with these changes or any loss of revenue resulting from modified or discontinued Marks.
