Is initial training mandatory for all new City Wide franchisees?

4.1 Initial Training. Initial training is required for all new CITY WIDE franchisees, including new franchisees entering the CITY WIDE system through a transfer of a Franchised Business. CITY WIDE will provide mandatory initial training programs for three people: (1) Franchisee (or if Franchisee is not a natural person, for one (1) shareholder, partner, or officer of Franchisee as designated by Franchisee and approved by CITY WIDE) and two (2) other people of the Franchised Business in the Designated Territory. CITY WIDE may elect not to provide such initial training if CITY WIDE determines, at its sole and absolute right, that such training is not required. Training will not begin until Franchisee has obtained financing or shown sufficient assets to satisfy CITY WIDE of Franchisee's ability to meet its financial obligations under the Agreement, and Franchisee has started the online City Wide YOU training program. Before or at the commencement of the initial training program, CITY WIDE will procure and configure laptop hardware for Franchisee and its employees, for use in the operation and management of your Franchised Business (such Software and hardware collectively, "Technology System"). CITY WIDE may also make available such other required or optional training programs as CITY WIDE deems necessary and appropriate. According to City Wide's 2025 Franchise Disclosure Document, initial training is generally required for all new franchisees, including those entering the system through a transfer. City Wide will provide mandatory initial training programs for three people: the franchisee (or a designated representative if the franchisee is not an individual) and two other people from the franchised business in the designated territory. However, City Wide retains the right to determine, at its sole discretion, that such training is not required in certain cases.
Before training commences, the franchisee must secure financing or demonstrate sufficient assets to cover their financial obligations under the franchise agreement and begin the online City Wide YOU training program. City Wide will also provide and configure laptop hardware and software for the franchisee and their employees to manage the franchised business.
The training program covers various aspects of the City Wide business model, including conceptual plans, promotion, advertising, marketing techniques, business operating procedures, general office practices, implementation of the City Wide system, software usage, and communication of standards. Franchisees must ensure that all individuals they employ are adequately trained. If new managers, salespersons, or quality-control personnel are appointed after the initial training, City Wide may require and provide training for them, with the franchisee responsible for covering the expenses associated with attending such training.
City Wide also has the right to require experienced franchisees and their employees to attend refresher training programs or seminars, up to two programs per year, not exceeding four calendar days in total. Franchisees are responsible for all expenses related to these refresher programs. Furthermore, City Wide can terminate the franchise agreement if it determines that the franchisee or their designees cannot satisfactorily complete the initial training program, in which case City Wide will return the initial franchise fee minus training expenses, capped at $10,000.
