What happens if a City Wide franchisee's proposed advertising materials are deemed disapproved?

City_Wide Franchise · 2025 FDD

Answer from 2025 FDD Document

CITY WIDE provides pre-approved marketing collateral for your usage. If you chose to produce additional materials for your use, at your own cost, you must consult with CITY WIDE and CITY WIDE must approve the advertising or collateral materials in advance which includes obtaining approval from CITY WIDE to utilize the marks before you produce or distribute anything. CITY WIDE will review and approve or disapprove all promotional and advertising materials prior to franchisee's use and within three business days of CITY WIDE's receipt of such materials. If CITY WIDE does not respond to your request within that time, your proposed materials will be deemed disapproved.

What This Means (2025 FDD)

According to City Wide's 2025 Franchise Disclosure Document, franchisees must consult with City Wide and receive approval before producing or distributing any advertising or collateral materials, including obtaining approval to use City Wide's marks. City Wide will review the materials within three business days of receipt.

The FDD states that if City Wide does not respond to a franchisee's request for approval of advertising materials within three business days, the proposed materials will be deemed disapproved. This implies that the franchisee cannot use the advertising materials if City Wide does not explicitly approve them within the specified timeframe or if they are explicitly disapproved.

This requirement ensures that all advertising and promotional efforts align with City Wide's brand standards and marketing strategies. It is a common practice in franchising to maintain brand consistency and protect the brand's image. Franchisees should factor this review period into their marketing timelines to avoid delays in their promotional activities.
