What This Means (2025 FDD)
According to Circle K's 2025 Franchise Disclosure Document, the terms 'credit card' or 'credit cards' within the Credit Network Agreement encompass not only traditional credit cards but also debit cards, stored value cards, and any other types of transaction payment cards. These cards must be approved by TMC Franchise Corporation (TMC) or its affiliates under the Credit Card Program. This definition applies to the agreement governing the acceptance and processing of payments for customer purchases at Circle K. TMC can modify the accepted payment methods under the Credit Card Program from time to time.
This broad definition means that Circle K franchisees must be prepared to accept a variety of payment methods beyond standard credit cards, provided they are approved by TMC. Franchisees need to stay updated on the types of payment cards TMC approves to ensure compliance with the Credit Card Program. Failing to accept approved payment methods could be a breach of the Credit Network Agreement.
The agreement also stipulates that franchisees must forward all customer applications for Circle K-branded credit cards to TMC for approval and card issuance. This requirement highlights Circle K's effort to promote its branded credit cards through its franchise network. Franchisees must not discriminate against Circle K credit card holders compared to holders of other credit cards.
Overall, the Credit Network Agreement outlines the responsibilities of Circle K franchisees in processing various payment methods and promoting Circle K's branded credit cards. Franchisees should carefully review the terms and conditions established by TMC and its affiliates to ensure they meet all requirements for participation in the Credit Card Program.
