What This Means (2025 FDD)

According to Circle K's 2025 Franchise Disclosure Document, Circle K may assist franchisees in developing their own advertising programs. Specifically, upon the franchisee's request, Circle K will assist in preparing or otherwise developing the franchisee's own advertising programs.

Circle K also initiates sales, loyalty, and marketing programs to promote the business of all Circle K stores, and franchisees are required to participate fully in these programs unless excused in writing by Circle K. These programs may include gift certificates, coupons, direct mail, telemarketing, interchange programs, combination selling programs, or advertising in the yellow pages with other franchisees.

Additionally, Circle K will reasonably assist franchisees with developing and carrying out a grand opening advertising and promotional campaign, and will furnish franchisees with a grand opening materials package. However, all grand opening activities and related publicity and promotional materials must receive Circle K's prior written approval, and all publicity and promotional costs are at the franchisee's sole expense. Circle K may reimburse franchisees for pre-approved expenditures, specifically $0.50 for each $1.00 the franchisee spends, up to a maximum reimbursement of $4,000.

Circle K also reserves the right to form an advertising council composed of elected franchisees. If such a council is formed and a franchisee is elected, the franchisee agrees to abide by all rules and regulations and participate in the council's meetings. Circle K may also establish local marketing groups (LMGs) comprised of franchisees in a specific geographic territory to conduct and administer advertising and promotions, and franchisees agree to participate in such LMGs if one is formed in their area. All advertising and promotions conducted by the LMG must be pre-approved in writing by Circle K.
