What This Means (2025 FDD)
According to Circle K's 2025 Franchise Disclosure Document, all notices required or permitted to be given to TMC under the agreement must be in writing. These notices can be made via overnight courier service, personal service upon an officer, or sent by prepaid registered or certified United States mail to any officer of TMC.
Notices sent via overnight courier are deemed duly given 24 hours after sending. For notices sent through certified or registered mail, they are considered duly given five days after being deposited in the United States mail for certified or registered delivery. The address for TMC is 1130 West Warner Road, Tempe, Arizona 85284, Attention: Worldwide Franchising Group.
For a Circle K franchisee, this means that any formal communication required under the franchise agreement, such as providing financial reports or requesting consent for a transfer of ownership, must follow these specific methods to be considered valid. Using unapproved methods like regular mail or email may not satisfy the notification requirements and could potentially lead to misunderstandings or breaches of contract.
