What This Means (2025 FDD)

According to Circle K's 2025 Franchise Disclosure Document, Circle K may provide notice or other information to the licensee through various electronic or telephonic means. These include facsimile, the Internet, or other online methods.

In contrast, if the licensee needs to provide notice to TMC Franchise Corporation, the acceptable methods are more specific and traditional. The licensee must provide notice in writing via overnight courier service, personal service upon a TMC officer, or prepaid registered or certified United States mail to a TMC officer at 1130 West Warner Road, Tempe, Arizona 85284, Attention: Worldwide Franchising Group. Notices sent by overnight courier are considered duly given 24 hours after sending, while those sent via certified or registered mail are considered given five days after deposit in the mail.

The agreement specifies that notice delivered by a service requiring a written receipt signed by the addressee is considered personal service. This distinction highlights that Circle K has more flexibility in how it communicates with franchisees, while franchisees must adhere to more formal methods when communicating with Circle K.
