What are the 'Marks' that the franchisee is licensed to use for the Circle K store?

According to Circle K's 2025 Franchise Disclosure Document, the "Marks" that franchisees are licensed to use include the name "Circle K," along with other distinctive trademarks, trade names, service marks, copyrights, interior and exterior building designs and specifications (including the unique motif, décor, and color combinations that comprise the trade dress of Circle K Stores), slogans, logos, social media indicators, social media handles and commercial symbols. These Marks are identified in the Business Systems Manuals or otherwise communicated by Circle K in writing.

Circle K franchisees must operate their stores under the name "Circle K" and cannot change this name or use any other marks or names without prior written approval from Circle K. Franchisees are required to indicate on business-related materials that they are a "Circle K®" franchisee and display signs at their location indicating independent ownership and operation as a franchised Circle K store.

Circle K retains the right to modify or discontinue any Marks and substitute different trade names, service marks, trademarks, logos, designs, and commercial symbols. Franchisees are obligated to make modifications to displayed Marks at their own expense upon Circle K's written instructions and within the specified timeframe. Franchisees must also cease using discontinued Marks and begin using the new Marks as directed by Circle K.

It is important for prospective Circle K franchisees to understand the scope and limitations of the license granted, as well as Circle K's rights to modify the Marks. Franchisees should carefully review the Business Systems Manuals and any written communications from Circle K to stay informed about the current Marks and any changes that may occur. Unauthorized use of the Marks or the Business System constitutes an infringement of Circle K's rights and a material default under the Franchise Agreement.
