What This Means (2025 FDD)
According to the 2025 Circle K Franchise Disclosure Document, TMC Franchise Corporation, as the franchisor, has received the right from its affiliate to license the Circle K Business System and Marks to individuals and entities that meet its qualifications. This right allows Circle K to expand its brand by granting licenses to qualified franchisees who will operate retail convenience stores under the Circle K name. The prospective franchisee must meet the standards established by Circle K to be granted the right to use the Circle K name and business system.
This agreement ensures that Circle K maintains control over its brand and business operations by setting specific qualifications for franchisees. It also emphasizes that the franchisee's rights are subject to the terms and conditions of the franchise agreement, including compliance with uniformity requirements and quality standards. The franchisee acknowledges that Circle K would not grant these rights or provide proprietary information without the franchisee's agreement to these terms, including the payment of fees.
In practical terms, this means that Circle K retains the authority to select and approve franchisees who meet its criteria, ensuring consistency and quality across all franchised locations. This benefits both Circle K and its franchisees by maintaining brand integrity and customer trust. The franchise agreement outlines the specific obligations and responsibilities of both parties, providing a framework for a successful business relationship. Prospective franchisees should carefully review these terms to understand their rights and obligations under the franchise agreement.
