What This Means (2025 FDD)
According to Circle K's 2025 Franchise Disclosure Document, franchisees must obtain an integrated electronic point of sale scanning cash register/motor fuel dispenser controller system, referred to as the "EPOS System", for store management. This system is essential for recording management, accounting, and record-keeping functions, utilizing specific computer hardware and software designated by Circle K, including any future enhancements and upgrades. The FDD specifies that Circle K currently requires franchisees to use Verifone or Radiant for the EPOS System. The cost for the EPOS System currently ranges from approximately $38,000 to $45,000.
In addition to the EPOS System, Circle K may also require franchisees to install a back-office computer system, including both hardware and software, or other communication or data storage systems, referred to as "Computer Systems". These Computer Systems may require franchisees to attend training, purchase ongoing support, and perform periodic upgrades. Franchisees are responsible for all costs associated with these Computer Systems, including software licenses, training, support, and upgrades. Circle K has the right to designate the source from which franchisees must purchase these systems.
It is important to note that neither Circle K, nor any affiliate or third party, is obligated to provide ongoing maintenance, repairs, upgrades, or updates for the EPOS System or Computer Systems. While Circle K does not currently require franchisees to purchase a maintenance, repair, upgrade, or update service contract for these systems, they reserve the right to do so in the future. Franchisees are also responsible for ensuring compliance with all applicable laws related to the EPOS System or other technology used in the operation of their store, including data protection, security laws, and PCI compliance. Franchisees must also enter into a Software Agreement and may be required to pay a monthly maintenance and support fee for the use and upgrades of their TMC Software, although there is currently no fee being charged.
