Answer from 2025 FDD Document

There are no agreements currently in effect that significantly limit your right to use any of our copyrights. Also, there are no currently-effective determinations of the USPTO, Copyright Office (Library of Congress) or any court involving any of our copyrights discussed above. We are unaware of any infringing uses of or superior prior rights to any of our copyrights that could materially affect your use of them in the state in which your Bakery will be located.

Your obligations and ours to protect your rights to use our copyrights are the same as the obligations for Proprietary Marks described in Item 13.

What This Means (2025 FDD)

According to the 2025 Cinnabon Franchise Disclosure Document, there are currently no agreements in effect that would significantly limit a franchisee's right to use Cinnabon's copyrights. The FDD also states that there are no current determinations from the USPTO (United States Patent and Trademark Office), the Copyright Office, or any court that would impact these copyrights. Cinnabon is also unaware of any infringing uses or superior prior rights that could materially affect a franchisee's use of their copyrights in the state where their bakery will be located.

This statement provides reassurance to potential Cinnabon franchisees that their ability to utilize Cinnabon's copyrighted materials for their business operations is not restricted by any existing agreements or legal challenges. These copyrighted materials include manuals, recipes, building designs, advertisements, images, and promotional materials. Franchisees are expected to adhere to Cinnabon's guidelines for the proper use and marking of these copyrighted materials, as outlined in the manuals.

It's important for prospective franchisees to understand that while no current limitations exist, this could change in the future. Cinnabon's rights are subject to change through new agreements, legal challenges, or other unforeseen circumstances. Therefore, it is prudent for franchisees to stay informed of any updates or changes to these rights during the term of their franchise agreement.

In addition, the FDD clarifies that a franchisee's obligations to protect their rights to use Cinnabon's copyrights are the same as their obligations to protect the Proprietary Marks, as described in Item 13 of the FDD. This means franchisees have a responsibility to safeguard Cinnabon's intellectual property and report any potential infringements or misuse of these assets.
