What This Means (2025 FDD)
According to Cinnabon's 2025 Franchise Disclosure Document, the Site Agreement refers to either the lease, sublease, or other rental agreement for the bakery location, known as the Lease, or the purchase agreement for the location, known as the Purchase Agreement. These documents, whether a Lease or a Purchase Agreement, are collectively termed the Site Agreement.
As a prospective Cinnabon franchisee, it's crucial to understand that you are solely responsible for negotiating the terms of the Site Agreement and fulfilling its obligations. While Cinnabon has the right to review the Site Agreement before its execution to ensure it meets their requirements, they are not obligated to do so. This means the onus is on you to ensure the agreement is favorable and compliant.
This aspect of the franchise agreement highlights the importance of due diligence when selecting a location. Cinnabon's review, if conducted, is primarily to verify compliance with their standards, not to assess the financial viability or suitability of the location for your business. Therefore, engaging legal counsel to review the Site Agreement and conducting thorough market research are essential steps to protect your investment and ensure the long-term success of your Cinnabon bakery.
