Answer from 2024 FDD Document

requested by us or our counsel that are necessary to protect our Marks or to maintain their validity and enforceability. We may substitute different Marks to identify the business conducted under the CINCH I.T. System if we can no longer use or license the Marks, or if we decide that substitution of different Marks is beneficial for the System.

If that happens, you will be responsible for your tangible costs of complying (for example, changing signs or advertising materials). You must not directly or indirectly contest our right to our Marks, trade secrets or business techniques that are part of our business.

What This Means (2024 FDD)

According to Cinch I.T.'s 2024 Franchise Disclosure Document, Cinch I.T. may substitute different Marks to identify the business under two specific conditions. First, if Cinch I.T. can no longer use or license the Marks. Second, if Cinch I.T. decides that the substitution of different Marks is beneficial for the Cinch I.T. System.

If Cinch I.T. does substitute different Marks, the franchisee is responsible for the tangible costs of complying with the change. These costs could include changing signs or advertising materials. This means a franchisee should be prepared for potential expenses related to rebranding if Cinch I.T. deems it necessary.

Furthermore, the franchisee must not directly or indirectly contest Cinch I.T.'s rights to their Marks, trade secrets, or business techniques. This underscores the franchisor's control over the brand and its associated intellectual property. Franchisees must also sign all documents requested by Cinch I.T. or their counsel to protect the Marks or maintain their validity and enforceability.
