What This Means (2024 FDD)
According to Cinch I.T.'s 2024 Franchise Disclosure Document, a franchisee may be considered in default if a judgment has been entered against an employee involving any claim, crime, or offense that is likely to adversely affect the franchisee's reputation, Cinch I.T.'s reputation, the reputation of the franchised business, the Cinch I.T. system or marks, Cinch I.T.'s business, or the business of any other Cinch I.T. franchisor-, franchisee- or affiliate-owned business.
This provision underscores the importance Cinch I.T. places on maintaining a positive brand image and reputation. Franchisees are responsible for ensuring that their employees' actions, both within and outside the business, do not negatively impact the Cinch I.T. brand. This extends the franchisee's responsibility beyond just the direct operation of the business to include the conduct and background of their employees.
Prospective franchisees should carefully consider this requirement and implement thorough background check procedures for all employees. They should also be aware of the potential consequences of employing individuals against whom adverse judgments have been entered, as this could lead to a default under the franchise agreement. This clause highlights the interconnectedness of all Cinch I.T. businesses and the shared responsibility for upholding the brand's reputation.
