What This Means (2024 FDD)
According to the 2024 Cinch I.T. Franchise Disclosure Document, the franchisee (referred to as "You" in the document) is responsible for determining the terms and conditions of employment for their employees. However, Cinch I.T. does set some parameters regarding who a franchisee can employ.
Specifically, Cinch I.T. requires franchisees to conduct reasonable background checks on all employees before hiring them and to keep copies of this information as specified in the Confidential Operations Manual. Furthermore, franchisees are prohibited from employing or continuing to employ individuals who have been convicted of a felony, engaged in gross misconduct that could harm the business or the Cinch I.T. system, or have had a judgment entered against them for a crime or offense that could negatively impact the reputation of the franchisee, Cinch I.T., or its affiliates.
While the franchisee has autonomy in setting employment terms, these stipulations from Cinch I.T. aim to protect the brand's reputation and maintain standards across all franchise locations. This is a fairly common practice in franchising, where franchisors set minimum standards for employees to protect the brand.
