What This Means (2024 FDD)

The 2024 Franchise Disclosure Document for Cinch I.T. does not explicitly state whether Cinch I.T. owns any patents or has any patent applications related to the franchise. However, Item 13 does mention that franchisees will be granted the non-exclusive right and obligation to operate a Cinch I.T. franchised business under their Proprietary Marks and System. It also states that franchisees may use other current or future Marks that Cinch I.T. may designate to identify the goods and services associated with the Cinch I.T. System. Cinch I.T. will license trademarks registered with the United States Patent and Trademark Office (USPTO). Item 14 discusses copyrights and proprietary information, stating that client lists are Cinch I.T.'s proprietary information. Item 23 mentions that the Cinch I.T. system includes trade names, trademarks, trade dress, logos, service marks, trade symbols, associated logos, designs, URLs, domain names, website addresses, email addresses, digital cellular addresses, wireless web addresses, copyrights, and such other trade names and trademarks as Franchisor may develop in the future for the purposes of identifying CINCH I.T. SYSTEM. It also includes distinctive sales and marketing procedures; knowledge and procedures for providing business computer support, general I.T. support, and other technology related services; inventory, management and financial control methods; and training and assistance, all of which may be changed, improved and further developed by Franchisor from time to time ("Trade Secrets").

While the FDD mentions trademarks, service marks, copyrights, trade secrets, and proprietary information, it does not directly address patents or patent applications. This means that the specific protections afforded by patents are not discussed in the context of the Cinch I.T. franchise.

A prospective franchisee should seek clarification from Cinch I.T. regarding any patents or patent applications related to the Cinch I.T. system. Understanding the intellectual property protections in place is crucial for assessing the long-term value and competitive advantage of the franchise.
