- (m) You acknowledge and agree that exchanging information with Us by electronic transmission ("e-mail") is efficient and desirable for day-to-day communications and that We and
You may utilize e-mail for such communications. You authorize the transmission of e-mail by Us and Our employees, vendors, and affiliates ("Official Senders") to You during the Term and any renewal thereof. You further agree that: (a) Official Senders are authorized to send emails to those of Your employees as You may occasionally authorize for the purpose of communicating with Us; (b) You will cause Your officers, managers, directors, and employees to give their consent to Official Senders' transmission of emails to them; (c) You will require such persons not to opt out or otherwise ask to no longer receive emails from Official Senders during the time that such person works for or is affiliated with You; and (d) You will not opt out or otherwise ask to no longer receive emails from Official Senders during the Term and any renewal thereof. The consent given in this Subsection will not apply to the provision of notices by either party under this Agreement pursuant to Section 36 unless the parties otherwise agree in a written document signed by both parties.

What This Means (2024 FDD)
According to Cinch I.T.'s 2024 Franchise Disclosure Document, Cinch I.T. considers exchanging information via email to be efficient and desirable for day-to-day communications. As a franchisee, you agree to this method of communication. Cinch I.T. and its employees, vendors, and affiliates are authorized to send emails to you during the term and any renewal thereof.
As a Cinch I.T. franchisee, you are responsible for ensuring your employees consent to receive emails from Cinch I.T.'s official senders. Furthermore, you must ensure that your employees do not opt out of receiving these emails during their employment or affiliation with your franchise. You also agree not to opt out of receiving emails from Cinch I.T. during the term of the Franchise Agreement and any renewals.
This consent does not extend to the provision of notices under Section 36 of the agreement unless both parties agree otherwise in writing. This means that while email is the standard for daily communication, formal legal notices may require a different method of delivery unless specifically agreed upon in writing.
