- (h) Immediately upon notification, You shall discontinue any advertising, marketing or promotional programs that would, in Our sole opinion, be detrimental to the CINCH I.T.
System, Marks, Us, Our affiliates or other franchisees.
- (ii) Who engages in gross misconduct, which results in, or would likely result in material and demonstrable damage to Your Franchised Business, the CINCH I.T.
System or Marks, Our business, or the business of any other CINCH I.T.
Franchisor-, franchiseeor affiliate-owned business; or,
- (iii) Against whom has been entered any judgment involving any claim or other crime or offense that is likely to adversely affect Your reputation, Our reputation, or the reputation of Your CINCH I.T.
Franchised Business, the CINCH I.T.
System or Marks, Our business, or the business of any other CINCH I.T.
Franchisor-, franchisee- or affiliateowned business.

What This Means (2024 FDD)
According to Cinch I.T.'s 2024 Franchise Disclosure Document, several actions can be considered detrimental to the Cinch I.T. system, its marks, the franchisor, its affiliates, or other franchisees. Cinch I.T. has the right to require a franchisee to discontinue any advertising, marketing, or promotional programs that, in Cinch I.T.'s opinion, would be detrimental to the Cinch I.T. system.
Additionally, Cinch I.T. franchisees must conduct reasonable background checks on all employees before hiring them. Franchisees cannot employ or continue to employ anyone convicted of a felony, who engages in gross misconduct that could damage the franchised business or the Cinch I.T. system, or against whom there is a judgment involving a claim or offense that could adversely affect the reputation of the franchisee, Cinch I.T., or other Cinch I.T. businesses.

Prospective franchisees should be aware of these restrictions and ensure they comply with all advertising and employment guidelines to avoid potential conflicts with Cinch I.T.
