What This Means (2024 FDD)
According to Cinch I.T.'s 2024 Franchise Disclosure Document, a franchisee can transfer the franchise under certain conditions. As detailed in Item 17, Section 28 of the franchise agreement, the franchisee must not be in default at the time of the transfer. Additionally, the franchisee is required to sign a release as part of the transfer process.
The proposed transferee must meet the qualifications of a new Cinch I.T. franchisee. This includes signing the then-current franchise agreement and completing the required training. The transferee will also need to pay a training fee and a transfer fee to Cinch I.T.
Cinch I.T. also retains a right of first refusal. According to Section 31, Cinch I.T. has 30 days to match any bona fide offers for the franchisee's business. This means that before a franchisee can accept an offer from a third party, Cinch I.T. has the option to purchase the franchise on the same terms. Furthermore, Section 29 states that in the event of death or disability, the franchise may be transferred to a spouse, heirs, or relatives if they are qualified; otherwise, the estate has 6 months to transfer the franchise to a qualified buyer.
