What This Means (2024 FDD)
According to Cinch I.T.'s 2024 Franchise Disclosure Document, upon the expiration or termination of the Franchise Agreement, a franchisee's marketing activities are limited to the Designated Territory outlined in their individual Franchise Agreements. This means that once the agreement ends, the franchisee can only market their Cinch I.T. business within the specific geographic area that was initially assigned to them.
During the term of the Franchise Agreement, Cinch I.T. franchisees are generally restricted from actively marketing outside their Designated Territory, with some exceptions for activities like attending tradeshows with prior written permission. However, they can accept and service clients from outside their territory without special permission or payment. The expiration or termination of the agreement removes the franchisee's right to operate under the Cinch I.T. brand and system, and consequently, their marketing efforts must be confined to the originally defined Designated Territory.
This restriction is a significant consideration for prospective franchisees. It highlights the importance of thoroughly understanding the boundaries and potential of the Designated Territory before entering into a Franchise Agreement with Cinch I.T. Franchisees should evaluate whether the territory provides sufficient business opportunities to sustain their operations, especially considering that their marketing reach will be limited to that area after the agreement expires or is terminated.
