What This Means (2024 FDD)
According to the 2024 Cilantro Taco Grill Franchise Disclosure Document, if both parties mutually agree to certain negotiated changes during the Initial Term or Renewal Term, the franchisee acknowledges and agrees to sign an addendum. This addendum will be in the form attached as Attachment 9 or any form Cilantro Taco Grill may require in the future.
The revisions contained in this addendum are considered added terms to the Franchise Agreement. The agreement specifies that no other changes shall be made to the form of the addendum itself, indicating that the franchisee's ability to negotiate further modifications to the addendum is limited.
This clause ensures that any modifications to the original agreement are documented and agreed upon in writing, providing clarity and legal certainty for both parties. It also highlights the importance of carefully reviewing and understanding any proposed addenda before signing, as these will become binding terms of the franchise agreement. Franchisees should seek legal counsel to fully understand the implications of any addendum before committing to it.
