What This Means (2025 FDD)
According to Cicis's 2025 Franchise Disclosure Document, if a franchisee fails to actively operate their Cicis restaurant for 3 or more consecutive days, it constitutes a non-curable default. This is outlined in Section 15.A of the Franchise Agreement under the definition of "Cause".
This means that Cicis can terminate the franchise agreement immediately without providing an opportunity for the franchisee to correct the issue. This is a serious matter, as it could lead to the loss of the franchise and the associated investment.
It is important to note that this provision does not apply if the closure is permitted under the Reopen Incentive Addendum. Franchisees should ensure they understand the terms of the Franchise Agreement and any addenda to avoid unintentional default and potential termination.
