5.2. Site Selection and Build Out.
(a) Site Selection. You must select a site for the operation of your Business.
We may provide you with site selection guidelines in the Operations Manual or otherwise in writing.
You agree to obtain our written consent for your proposed site.
You may operate the Business only from the accepted site.
If you fail to secure a site of which we approve, we may terminate this Agreement.
(b) Lease. Before you sign a lease, sublet a space, purchase space, or make any binding commitment to do so, you must provide us a copy of the proposed lease, sublease, or purchase agreement, and you must obtain our prior written approval hereof, which we will not unreasonably withhold.
(c) Buildout. It is your responsibility to conform the premises with federal, state, or local ordinances, building codes, licensing requirements and obtain any required permits.
(d) Plans and Layout. You are required to submit the layout and have it approved by us.
We will approve or disapprove a proposed layout within 14 days of your submission to us.
Once approved by us, it is your responsibility to remodel the premises and install the furniture, fixtures, and equipment accordingly.
- (e) Relocation Review. You must obtain our prior written consent, which will not be unreasonable withheld, if you wish to relocate your Main Office and/or an Additional Office.
The "new" location must comply with all applicable provisions of this Agreement and with our then-current specifications and standards for CHRISTIE'S INTERNATIONAL REAL ESTATE businesses.
If you must relocate the Main Office and/or an Additional Office because it was destroyed, condemned, or otherwise became untenantable by fire, flood, or other casualty, you must reopen the replacement office within 90 days after you discontinue operation at the prior office.
- (f) You acknowledge and agree any approval or recommendation of a site or location for your Business is not a representation or warranty of any kind, express or implied, of the suitability of the site for a CHRISTIE'S INTERNATIONAL REAL ESTATE business or any other purpose.
Our recommendation indicates only that we believe that the site meets our then acceptable criteria.
In addition, any recommendations, suggestions, or approvals of a proposed site are not a warranty, guarantee or representation that the site will achieve any level or amount of sales, revenue or profit as a CHRISTIE'S INTERNATIONAL REAL ESTATE business location.
You acknowledge and agree that your acceptance of the obligation to develop the CHRISTIE'S INTERNATIONAL REAL ESTATE business is based on your own independent investigation of the suitability of the site for the CHRISTIE'S INTERNATIONAL REAL ESTATE business.

What This Means (2025 FDD)
According to the 2025 FDD, a Christies International Real Estate franchisee must obtain written consent from the company for their proposed business site. The franchisee can only operate the business from a site that Christies International Real Estate has approved. Failure to secure an approved site can result in the termination of the franchise agreement.
Before signing any lease, sublease, purchase agreement, or making any binding commitment for a site, the franchisee must provide Christies International Real Estate with a copy of the proposed agreement and obtain their prior written approval, which Christies International Real Estate will not unreasonably withhold. The franchisee is responsible for ensuring the premises comply with all applicable federal, state, and local ordinances, building codes, and licensing requirements, as well as obtaining any necessary permits.
Furthermore, the franchisee is required to submit the layout of the site for approval, which Christies International Real Estate will either approve or disapprove within 14 days of submission. Once the layout is approved, the franchisee is responsible for remodeling the premises and installing furniture, fixtures, and equipment accordingly. If a franchisee wishes to relocate their Main Office or an Additional Office, they must also obtain prior written consent from Christies International Real Estate, which will not be unreasonably withheld, and the new location must comply with all applicable provisions of the franchise agreement and Christies International Real Estate's current specifications and standards.
Christies International Real Estate approval or recommendation of a site does not constitute a representation or warranty of the site's suitability for a Christies International Real Estate business or any other purpose. It only indicates that Christies International Real Estate believes the site meets their acceptable criteria. Any recommendations, suggestions, or approvals of a proposed site do not guarantee any level or amount of sales, revenue, or profit for the location. The franchisee acknowledges that their decision to develop the Christies International Real Estate business is based on their own independent investigation of the site's suitability.
