What This Means (2025 FDD)
According to the 2025 Christies International Real Estate FDD, the Release document can be executed in counterparts. This means that each party can sign a separate copy of the Release, and all signed copies together will be considered a single, binding agreement. Signatures can be exchanged via fax or PDF.
This flexibility simplifies the signing process, especially when the parties are geographically separated. It allows Christies International Real Estate and the franchisee to complete the agreement efficiently without needing to physically exchange a single document. The FDD specifies that all identical copies of the Release, when signed, are considered as one complete Release.
This practice is fairly common in franchising and business agreements generally, as it streamlines the execution of documents. However, it is important for both Christies International Real Estate and the franchisee to ensure that all counterpart copies are identical to avoid any discrepancies or misunderstandings about the terms of the Release.
