What This Means (2025 FDD)

According to the 2025 Christies International Real Estate Franchise Disclosure Document, the 'Marks' are defined as the trademarks, service marks, and other commercial symbols that Christies International Real Estate designates for use within its System. The System itself encompasses luxury real estate brokerage products and services, approved products, distinctive equipment including computer systems, confidential information, marketing techniques, operating procedures, quality standards, business methods, the Operations Manual, and other expertise provided by Christies International Real Estate. Therefore, the Marks are a subset of the overall System, representing the brand's identity and reputation.

Christies International Real Estate retains significant rights regarding the Marks. They can use the Marks in any way not expressly prohibited in the franchise agreement. This includes operating or franchising businesses under the Marks outside a franchisee's protected territory, selling products under the Marks through various channels, advertising the System online, and modifying websites using the Marks. This reservation of rights allows Christies International Real Estate to adapt to market changes and pursue new business opportunities without being constrained by individual franchise agreements.

As a franchisee, you cannot represent that you own any of the Marks and must use them only in the manner prescribed by Christies International Real Estate. Specifically, the use of "CHRISTIE'S" must be in the phrase "CHRISTIE'S INTERNATIONAL REAL ESTATE," and you must use the designated font. Furthermore, you are obligated to market the Marks as a leading luxury brand and cannot associate other trademarks with more luxurious services or properties. These stipulations ensure brand consistency and prevent franchisees from diluting the brand's luxury image. Franchisees must also adhere to guidelines regarding luxury real estate, as defined by the IP Owner in the Trademark License Agreement, and cannot be directly or indirectly controlled by specified competitors.
