the foregoing, the
acceptance of any payment specified to be paid by Franchisee hereunder shall not be, nor
be construed to be, a waiver of any breach of any term, covenant or condition of this
Agreement.
- INTEGRATION OF AGREEMENT.
18.01 No Prior Representations. This Agreement, and all other agreements executed
contemporaneously with it, constitute the entire agreement between the Parties with
reference to the subject matter hereof and supersedes all prior negotiations, understandings,
representations and agreements, oral or written, if any. Franchisee acknowledges that it is
entering into this Agreement as a result of its own independent investigation of the business
and not as a result of any representations about the Franchisor by its agents, officers or
employees that are contrary to the terms set forth here or that are contrary to the terms of
any Disclosure Document, prospectus, disclosure document or other similar document
required or permitted to be given to Franchisee pursuant to applicable law. Franchisee, on

behalf of itself, its agents, officers and owners, hereby waives and releases all claims, if any, that it has been fraudulently induced to enter into this Agreement and/or the Commercial Sub-Lease Agreement.
