Under what condition is a site for a Chop5 Salad Kitchen Restaurant deemed disapproved?

fail to issue our written approval within the 30-day period. If we approve the site for your Restaurant prior to execution of this Agreement, then the address of the approved site will be listed in Part D of ATTACHMENT "A". If we do not approve the site for your Restaurant prior to execution of this Agreement, then within 15 days after we approve your site we will send you a Site Approval Notice that identifies the address of your approved site. Within five (5) business days after we send you the Site Approval Notice, you must sign and date the franchisee acknowledgment section and send us a copy for our records. Our approval of the site shall be deemed immediately effective and binding on you at the time we issue the Site Approval Notice, regardless of whether you send us the signed acknowledgment. Our approval of a site does not constitute a representation or warranty of any kind, express or implied, of the suitability of the site for a Restaurant. It indicates only that we believe the site meets our minimum criteria.

What This Means (2024 FDD)
According to Chop5 Salad Kitchen's 2024 Franchise Disclosure Document, if Chop5 Salad Kitchen fails to issue written approval of a proposed restaurant site within a 30-day period, the site is considered disapproved.
If Chop5 Salad Kitchen approves the site before the franchise agreement is executed, the approved site's address will be listed in Part D of ATTACHMENT "A" of the agreement. If the site is approved after the agreement is signed, Chop5 Salad Kitchen will send a Site Approval Notice within 15 days of approval, identifying the site's address. The franchisee must then acknowledge the notice within five business days.
It's important to note that Chop5 Salad Kitchen's approval of a site does not constitute a warranty of its suitability for a restaurant. It only indicates that the site meets the minimum criteria set by Chop5 Salad Kitchen. Franchisees are also required to contract with Chop5 Salad Kitchen's designated real estate company to assist in identifying sites and negotiating the lease or purchase agreement.
