What This Means (2024 FDD)

According to Chop5 Salad Kitchen's 2024 Franchise Disclosure Document, Item 17 details the provisions for renewal and extension of the franchise term. Specifically, FA: 4.1 & 4.2 of the Franchise Agreement outline the conditions under which a franchisee can renew their agreement. If the franchisee meets Chop5 Salad Kitchen's conditions for renewal, they can enter into up to two consecutive successor franchise agreements, each lasting five years. Further renewals may be mutually agreed upon, but neither party is obligated to do so, subject to state law.

To renew the Chop5 Salad Kitchen franchise, a franchisee must not be in default, provide timely notice, sign the then-current form of franchise agreement, sign a general release (subject to state law), pay a renewal fee, remodel the restaurant, upgrade furniture, fixtures, and equipment to current standards, and extend the lease for the duration of the renewal term. The FDD also notes that if a franchisee renews, they may be required to sign a contract with materially different terms and conditions than the original contract.

For franchisees entering into an Area Development Agreement (ADA), section ADA: 4.4 states that there are no renewal rights. This means that the terms for renewal and extension apply specifically to the standard Franchise Agreement and not to the Area Development Agreement. Prospective franchisees should carefully consider these differences when deciding which type of agreement to pursue with Chop5 Salad Kitchen.
